Special situations

  • Get this signed BEFORE paying anything. A creditor who has already been paid has no remaining incentive to agree to terms.
  • Forgiven debt can be taxable income to the debtor. A large settlement is worth asking a tax adviser about before agreeing.
  • Many settlements revive the original full balance on default, less payments made. Missing the last instalment can undo the whole discount.
  • A creditor can agree how an account is reported but cannot promise a credit bureau outcome, and accurate reporting generally cannot simply be deleted.

Frequently asked questions

Should I pay first and get the agreement afterwards?

No, and this is the single most important thing about settling a debt. Once you have paid, you have nothing left to negotiate with. Get the terms in writing and signed first, then pay.

Will settling hurt my credit?

Typically an account reported as settled rather than paid in full carries a negative mark. The agreement can record how the creditor will report it, but no creditor can promise what a bureau will show, and accurate reporting generally cannot be deleted. Be sceptical of anyone promising removal.

Do I owe tax on the forgiven amount?

Possibly. Forgiven debt can be treated as taxable income, and creditors may report it. For a substantial settlement, ask a tax adviser before agreeing — the tax can meaningfully reduce what you saved.

What happens if I miss a payment?

Usually the original full balance revives, less what you have paid. That is common and lawful, and it means the last instalment matters as much as the first. Make sure the schedule is one you can actually meet.

Can paying an old debt make things worse?

It can. In several states a payment restarts the limitation period, which can revive a claim that had become too old to enforce. If the debt is old, that is worth checking before you pay anything.
