Special situations
- Both parents with rights should normally sign. A single-parent authorization is routinely questioned and sometimes refused outright.
- This is not a custody order, a guardianship, or a power of attorney. It does not transfer custody and it does not survive a court order to the contrary.
- Schools, medical providers, and airlines commonly require their own forms as well. Ask each in advance rather than presenting this at the door.
- State what the caregiver may NOT decide. Anything not expressly limited can be argued to fall within a general authority.
- Where the arrangement is long, or arises from a family dispute, a temporary authorization is the wrong tool and advice is worth the cost.
Frequently asked questions
Do both parents need to sign?
Where both have parental rights, normally yes. Providers and schools routinely question an authorization signed by one parent, and in a disputed situation a single signature can create more problems than it solves.
Is this the same as guardianship?
No. Guardianship is a court process that transfers legal responsibility. This is a private authorization for day-to-day decisions over a defined period, and it can be revoked by the parents at any time.
Will the school accept it?
Often, but ask first. Schools and medical providers frequently have their own forms and their own requirements, and turning up with a document they have not seen is how a handover goes wrong at the worst moment.
Can the caregiver consent to medical treatment?
Only to the extent you authorize, and even then a provider may want to reach a parent for anything significant. If medical consent is a real possibility, the child travel and medical authorization is the more complete document.
How long can this last?
This form states no limit, because states treat that differently. For anything beyond a short defined period, a temporary authorization is usually the wrong instrument.
