Special situations

  • This package contains no court forms. Courts require their own current forms and reject substitutes, and divorce forms differ by state and often by county.
  • Incorrect service is the most common reason an uncontested divorce stalls after filing. Handing papers over privately is generally not service.
  • Anything involving children brings additional forms, disclosures, and court review against the child's best interests.
  • Agreeing between yourselves who pays a debt does not release either spouse from the lender.
  • Where there has been abuse, coercion, or a significant imbalance in information or bargaining power, get advice before filing anything.

Frequently asked questions

Does this include the divorce papers I file?

No. Courts require their own current forms, which differ by state and often by county, and a form from anywhere else is routinely rejected. This organises everything you bring to those forms.

What does uncontested actually mean?

That both spouses agree on the terms — property, debts, support, and any arrangements for children. If you agree on everything except one issue, the case is contested on that issue, and the process differs.

Why does service matter so much?

Because incorrect service is what stalls these cases. Formal service has specific requirements, and handing papers to your spouse yourself usually does not satisfy them. The tracking sheet exists because reconstructing service afterwards is what courts refuse to accept.

How long does it take?

It varies by state, and most impose a waiting period regardless of agreement. The eligibility worksheet has you record your own court's requirement rather than relying on a general figure.

What if we have children?

Expect additional forms, additional disclosure, and court review of any arrangement against the child's best interests. Parents cannot settle custody or child support between themselves in a way that binds the court.
